Amit Shah leaves Gujarat, heads towards Mumbai in morning flight
Ahmedabad, 31 October, 2010

Former minister of state for Home, Shri Amit Shah today morning left Gujarat obeying the Supreme Court order.

Shah left Ahmedabad by air in early morning flight that took him to Mumbai. It is not clear whether Shah took connecting flight from Mumbai to reach some other destination or not. Shah will anyway need to appear before CBI Police Station in Mumbai once in month as per the Gujarat High Court order.

On Saturday, Supreme Court Justice Aftab Alam had directed Shah:”It is in your interest if you stay away from Gujarat.”

The decision came at a special hearing at Mr Justice Aftab Alam’s residence on a plea by the Central Bureau of Investigation (CBI) for cancellation of Mr Shah’s bail.

The Supreme Court order came after the Central Bureau of Investigation (CBI) filed a petition seeking cancellation of the bail granted by the Gujarat High Court to Amit Shah and sought an urgent hearing. CBI told the Supreme Court that Shah may tamper with evidence while on bail.

The Gujarat High Court had on Friday granted Shah bail, three months after he was arrested in connection with the Sohrabuddin Sheikh fake encounter case.

Senior lawyer K.T.S. Tulsi, who appeared for CBI in the High Court, had told that the investigating agency had filed the petition since it was wary of Shah tampering with the evidence.

The bench, comprising Mr Justice Alam and Mr Justice R M Lodha, had then told Mr Shah to leave the State by Sunday morning and stay out till further orders. It posted the matter for hearing on November 15. Mr Shah’s lawyer Upendra Yadav had told the court that his client was ready to stay out of Gujarat as directed by the court.

The court asked the CBI to supply a copy of its petition to Mr Shah by November 6, who has to file his reply by November 12 after which the agency will file its rejoinder.

The court has issued a notice to Mr Shah, asking him to explain why his bail should not be canceled.
