Gujarat Congress has filed complaint before the Election Commission against alleged objectionable remarks by Ahmedabad East seat BJP candidate Paresh Rawal.

The complaint:

Sir,

As per the permission granted by the competent authority BJP candidate Shri Paresh Raval from 07-Ahmedabad East Parliamentary constituency had arranged and addressed a public meeting for campaigning of his election the venue of the meeting was Hirawadi-Bapunagar area, on 12.04.2014 as per the scheduled time of the permission the said meeting is videographed by the officers of the office of the returning office as well as by LCB / State IB Officials of the said constituency as well by the electronic media as per rules – practice and said meeting and the addressed of the said BJP candidate Shri Paresh Raval has also been recorded such as TV-9 Channel and is also broadcast amongst the public at large. Even the electronic media has described the said speech and public address of candidate Shri Paresh Raval as offensive deffemative, derogatory and is compared as identical to that of the address of the Amit Shah, Azamkhan as in UP. The said public speech delivered at the said meeting is apparently abusive, derogatory and attributing accusation and is dishonesty spoken words at the said public address amount to abating the public at large and is also tantamount to playing with the feelings, sensitivity of mass and is amount to cultivating, creating, professing and spreading over rumors in defamatory and derogatory language and is surely corrupt practice within the meaning of section 123 of R.P. Act 1951 and is also amount to constituting an offence under section 171 F and section 171-G of I.P. code and the same is not only an offence but is also in clear breach of the provision contain in article 324 (1) of the constitution of India and is also clearly in breach and violation of the guarantee contained in preamble of the constitution of India and is also violation of code of conduct.

It is further submitted that the public addressed in abusive language and putting an accusation against the Indian National Congress by the said candidate in following words “ મોદીએ લગ્ન કર્યા છે કે નહીં એની ચર્ચા કર્યા કરતાં, તમે દેશની માં પૈયણી નાંખી છે એનું શું?” the said public speech further abuses and putting and accusation against the congress leaders and personalities without any basis, material or evidence to substantiate any such accusation. Which clearly amount to provoking and abating or instigating the public at large – mass by creating, professing the feelings of hatred and “ ભડકાઉ ભાષણ ” and therefore he is required to be restrained from any further propaganda, canvassing or professing to canvas for voting in his favour or for BJP and is therefore requires to be restrain from participating any further in the election process for canvassing or professing at the parliamentary election 2014 till such election are complete and concluded.

It is therefore requested to kindly pass an order immediately by calling and examining the videography recorded by the returning officer, LCB / State IB office and “TV-9 Channel” in terms of what is contended herein above for restraining / preventing him from participating any further in election process of canvassing and public addressed or addressing any public meeting for election propaganda. Kindly take action and pass an order in terms of this prayer forthwith.
