“Gujarat Lokayukta’s appointment unconstitutional”

President of Bar Council of Gujarat J J Patel has termed the appointment of Justice (retd) R A Mehta by the governor as unconstitutional. Opposing the decision, he cited a case of Punjab wherein a bench of seven judges had observed that without the permission of the chief minister and the ministry, the governor cannot take such a decision. He further stated that the governor should abide by the laws of the state.
