Ahmedabad, 26 February 2013
Gujarat Congress today alleged that the BJP government in Gujarat is making Gujarat a separate Desh ( country ) which is against federal system.
A statement issued by Gujarat Congress says, “Gujarat’s Sardar Patel annexed native states and created India, and now present BJP government is going ahead to make Gujarat a separate country which is totally against federal system.”
The statement said, “Gujarat government passes unconstitutional laws through its majority in Gujarat assembly. Gujarat Green cess act-2011 was passed on the last day of Budget session of 12th Assembly which was 30th March. Gujarat’s honorable High Court abolished the Gujarat Green Cess Act-2011 and noted that while Central government’s Electricity Act 2003 is implemented, another law can not be dumped over it.”
The statement further said, “In 2001 Gujarat government had passed Gujarat Gas Act which was abolished by Supreme Court on 25 March 2004 slapping a verdict. Five Judges bench had while abolishing the act pointed out that it was unconsumer. By forming an illegal act, the state government had spent Rs 1200 crore and LNG terminals of Petronet and Shell came up in Dahej and Hazira respectively.”
The statement further said, “The court has ordered to pay back the tax collected by Gujarat government through Gujarat Green Cess Act-2011 with 8% interest.”
“Even after series of such examples of unconstitutional and autocratic exposure, the BJP government doesn’t show sign of any improvement. BJP government should take responsibility of such unconstitutional decisions and in future bring laws that are constitutionally valid,” Gujarat Congress Spokesperson Manish Doshi said in a written statement issued here.
