Trial Court approves SC appointed/monitored probe team’s clean chit to Narendra Modi in 2002 riot case(videos)

Ahmedabad, 26 December 2013

Ahmedabad Metropolitan Court has today in its around 350-page order rejected former Congress MP’s widow Zakia Jafri’s protest plea against the Supreme Court appointed/monitored Special Investigation Team(SIT)’s closure report. As SIT report has been accepted now by trial court, Zakia will have to go to Higher Court if she intends to challenge the trial court order. The SIT report had given clean chit to Narendra Modi and over 60 others.

Replying to media persons, SIT lawyer said, “I have yet not read 300-350 page order. Judge came out of his chamber and told Zakia’s lawyer Mihir Desai that Zakia’s protest plea was rejected.”

SIT lawyer Jamuar said, “our recommendation was that there was no evidence in the field during investigation to recommend criminal action against 63 persons. This court has taken cognizance that there can be no criminal action against Modi and others. Zakia’s complaint against Modi has gone in vein.”

Some of the observations in court order:

The court in its order observed:

-On phone call details: No recording available. It’s based on assumptions and presumption. If administration doesn’t contact its officers, how would it maintain law and order?

-Sanjeev Bhatt’s reliability in doubt: SIT has established he was not present in February 27 meeting. There’s no evidence of Modi having asked cops to go slow.

-Sreekumar started making allegations after he was superseded so he is not reliable. He is not material witness.

-On Newton’s law comment of Modi: It should be seen as in totality.

-Army was called on February 28 afternoon. But it was not available in Ahmedabad. So it had to be airlifted. So no conspiracy on part of Chief Minister.

-There was no larger conspiracy. Only an outburst of an excited and angry populace.

-No witness of dead bodies being paraded in Ahmdabad. It was proper to get the bodies to Ahmedabad.

-There are enough checks and balances in the constitution so that executive can not subvert judicial process.

-It can not be termed as genocide or ethnic cleansing.
