Gujarat High Court rejects Auto Driver’s plea to cancel the E-Memo
July 20, 2022
Ahmedabad: Gujarat High Court on Tuesday rejected a plea of an auto driver Rajveer Upadhyay who demanded the cancellation of an e-memo of Rs 300 issued by authorities for jumping the traffic signal.
The Petitioner’s advocate claimed that the notice issued to him under Sec 133 of Motor Vehicle Acts stipulates furnishing of information and hence the authority cannot levy a fine.
He also submitted that auto Rikshaw for which a fine is imposed does not belong to him and these provisions of the MV act are merely money extortion tactics of authorities.
However, the state government was able to counter his claims and explain the provisions under which the e-challan was issued to the court, after which the bench rejected Rajveer’s plea and instructed the government to prosecute him if he does not compound the offence.
