Ahmedabad Builder Sells Mortgaged Shop, Cheats Buyer of ₹1.10 Crore

Ahmedabad: A Vatva factory owner was allegedly cheated of ₹1.10 crore by a Maninagar builder and his son, who sold him a commercial shop without disclosing that it was mortgaged to a private finance company.

Maninagar police have booked builder Kamlesh Gondaliya and his son for cheating and criminal breach of trust after the buyer learnt that the shop had been sealed over an unpaid loan.

Rikesh Mistry, a Maninagar resident, agreed to buy Shop No. 10 on the ground floor of Taxila Crest, opposite Pushpakunj Society, in 2024. Between January and August 2025, he transferred ₹1.10 crore from his HDFC Bank account to Gondaliya’s Bank of India account through cheques and RTGS. The shop was registered in Mistry’s name on May 31, 2026.

On August 9, 2026, Mistry visited the property and found it sealed with an attachment notice from Aditya Birla Capital Finance. When he questioned Kamlesh’s younger brother, Rajesh Gondaliya, he was allegedly told that the loan clearance process was underway.

Kamlesh later sent Mistry an NOC via WhatsApp, raising further doubts. The document named Mistry’s father, Geetesh, instead of the buyer and mentioned an outstanding amount of ₹2,02,64,000 alongside a contradictory zero-balance claim.

Further inquiries allegedly revealed that the builder had mortgaged the shop to secure a project loan, diverted the buyer’s money for personal use and circulated forged documents to conceal the mortgage. Mistry subsequently filed a police complaint, leading to an FIR. DeshGujarat
