AAP leader Yuvrajsinh Jadeja and aides arrested in extortion and criminal conspiracy case

Bhavnagar: Special Operation Group (SOG) of Bhavnagar Police has booked Aam Aadmi Party (AAP) leader Yuvrajsinh and others under sections 386, 388 and 120B pertaining to extortion and criminal conspiracy in a complaint filed in Nilambagh police station. Yuvrajsinh made his name by supplying details of alleged irregularities in competitive and recruitment exams in recent years. He is now facing allegations of collecting money from those involved in dummy exam candidates scam in Bhavnagar for not revealing their names in press conferences and interactions. Last week, a viral video had mentioned how and how much money Yuvrajsinh collected to not disclose the names of some persons involved in exam related scam.
Yuvrajsinh was summoned for questioning a day before yesterday, however he told Police that he was unwell and he would require ten days to appear before Police. Police had given him fresh date of 21st April. Yuvrajsinh appeared before Special Operation Group (SOG) of Bhavnagar Police where Special Investigation Team (SIT) is probing the dummy exam candidates scam.
Range IG Gautam Parmat addressing the media in the evening stated that Yuvrajsinh during his questioning today was not giving a proper replies regarding his financial dealings. As per the details available to Police, Yuvrajsinh and his aid collected Rs. 1 crore sum by force from Pradip Baraiya and Prakash Dave, Parmar said.
He further stated- As per the complaint, on last 25th March, Yuvrajsinh and his men roamed in Bhavnagar region and captured video of one Rushi Baraiya, a dummy person in connection with dummy exam candidates row. Yuvrajsinh then through his aide Ghanshyam showed the video to Prakash Dave (PK)’s wife. Yuvrajsinh, his aide Ghanshyam Landhva and his men pressurized Prakash and his wife and relatives. During 25-26-27 Yuvrajsinh kept the pressure on them and later did a meeting on 28th in the evening. The meeting was held at Yuvrajsinh’s relative’s office. PK’s uncle, PK’s relative Ghanshyam, Yuvrajsinh’s aide Ghanshyam, Bipin Trivedi and Yuvrajsinh’s aides and relatives apart from one Raju attended the meeting.
Yuvrajsinh in this meeting threatened PK and said he was to address the press on 28th but he has postponed it for PK. Yuvrajsinh said that he was going to portray PK as the number one key person in the dummy exam candidate scam but he didn’t. Yuvrajsinh demanded Rs. 70 lakh sum and later after discussion finalized the deal for Rs. 45 lahks after many requests from PK. PK started collecting money on 29th morning. He took money from his father-in-law, cousins, uncle, own private fund, and cousin Ghanshyam Dhandhaliya and gave the sum to Yuvrajsinh’s aide Ghanshyam Landhva. A deal was finalized on 29th in a great relief to PK. Yuvrajsinh was to address the press on 5 April. Ahead of that he called Ghanshyam Landhva on whatsapp call and said he was going to reveal seven names and he may see the list to ensure that none of PK’s known persons is there in the list. The list was then scrutinized and OKayed by Ghanshyam.
Police said Yuvrajsinh didn’t just collect money from PK for not revealing his name but also collected money from another persons namely Pradip Baraiya to conceal his name also in presss conference and interactions. Police said – On 27th or 28th Yuvrajsinh’s aide Ghanshyam Ladhva had told Pradip Baraiya that his name was going to be revealed in the press conference by Yuvrajsinh in connection with dummy candidates row. Baraiya fearing to lose his govt job requested Ghanshyam to arrange a deal with Yuvrajsinh for not revealing his name. A meeting was held then on 30th in which Yuvrajsinh and others were present. Yuvrajsinh showed some names to Pradip and sought information regarding the dummy candidates scam. Yuvrajsinh said those names would be revealed in the press conference. Pradip asked for mercy and requested to spare him and asked for a way out. A deal was then requested for Rs. 10 lakh but Yuvrajsinh’s aide were not ready for this much of sum. They asked for Rs. 60 lahks. Later Pradip Baraiya cried , bow down to Yuvrajsinh and requested a cheaper deal. The deal was decided for Rs. 55 lakh at last. Pradip arranged money from his friends and relatives and gathered Rs. 55 lahks. This sum was sent to Yuvrajsinh in three installments. First installment was put in Yuvrajsinh’s relative Shivubha’s car. The secodn installment on 3rd April was Rs. 17 lakh and it was delievered to Yuvrajsinh aide Kanbha. On 4th April night at around 9 pm, Pradip and Jigadada handed over Rs. 2 lakh to Yuvrajsinh aide Ghanshyambhai in Alto car. Ghanshyam handed over this sum to Yuvrajsinh later. On 5th when Yuvrajsinh did press conference,he didn’t mention Baraiya’s name.
Range IG Gautam Parmar said, statements and circumstantial evidence were collected by Police in this connection, after whcih Yuvrajsinh was called for questioning. However Yuvrajsinh was not giving clear replies to Police. Police said Yuvrajsinh, Shivubha, kanbha, Ghanshyam Randhva, Bipin Trivedi and Raju are booked by Nilambagh Police Station under IPC 386, 388, and 120b. Police said Yuvrajsinh was detained and would be arrested soon and his remands will be sought in court.

Section 386 in The Indian Penal Code:
386. Extortion by putting a person in fear of death or grievous hurt.—Whoever commits extortion by putting any person in fear of death or of grievous hurt o that person or to any other, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
Section 388 in The Indian Penal Code:
388. Extortion by threat of accusation of an offence punishable with death or imprisonment for life, etc.—Whoever commits extortion by putting any person in fear of an accusation against that person or any other, of having committed or attempted to commit any offence punishable with death, or with 1[imprisonment for life], or with imprisonment for a term which may extend to ten years or of having attempted to induce any other person to commit such offence, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine; and, if the offence be one punishable under section 377 of this Code, may be punished with 1[imprisonment for life].
Section 120B in The Indian Penal Code:
1[120B. Punishment of criminal conspiracy.—
(1) Whoever is a party to a criminal conspiracy to commit an offence punishable with death, 2[imprisonment for life] or rigorous imprisonment for a term of two years or upwards, shall, where no express provision is made in this Code for the punishment of such a conspiracy, be punished in the same manner as if he had abetted such offence.
(2) Whoever is a party to a criminal conspiracy other than a criminal conspiracy to commit an offence punishable as aforesaid shall be punished with imprisonment of either description for a term not exceeding six months, or with fine or with both.]
