Gujarat minister of state for Home Shri Amit Shah will resign just before his arrest, whenever arrest takes place. This is the norm that Modi ministry has followed in past.

Mayaben Kodnani, former minister of Gujarat resigned last year from her post just before her arrest in criminal case that was about 2002 riot. Amit Shah’s resignation could be already in possession of Gujarat Chief Minister Narendra Modi, but the date and timing on that piece of paper would be typed just before Shah’s arrest. Detail is just coming in that Modi’s minister is chargesheeted as prime accused in Sohrabuddin encounter case. Chargesheet is considered as even bigger thing than the arrest, and Shah could resign on this ground too.

Shah is free to go to the High court for anticipatory bail. He can also go up to Supreme court for the same. In the meantime, he can rest and wait for the result of his application.

Following is Mayaben Kodnani’s case detail, how and when she resigned

-The SIT had issued summons on January 29 and 31 in 2009 to Gujarat Minister Mayaben Kodnani in the Naroda Patia and Naroda Gam riot cases but she never turned up, following which she was declared an absconder on February 2.

-Kodnani remained elusive for five days and then surfaced a day after Ahmedabad sessions court granted her anticipatory bail in connection with post-Godhra riots cases.

-SIT approached the high court seeking cancellation of the anticipatory bails granted to Mayaben by lower court.

-The Gujarat high court rejected the anticipatory bail plea of Maya Kodnani on March 27.

-Maya Kodnani resigned from the government after Gujarat High Court canceled her anticipatory bail.

-She was arrested and sent to jail.

-She was later released on bail, and she is free as of now. However with former minister tag.
