“You can restrain yourself for one or two days from eating…”: HC on slaughterhouse closure.
August 31, 2022
Ahmedabad: A petition was filed against Ahmedabad Municipal Corporation (AMC) order to close the slaughterhouses twice for the period of 5 and 7 days due to festivities. While listing to the petition yesterday, Justice Sanjeev Bhatt said, “You can restrain yourself for one or two days from eating…”
AMC had ordered to close the city’s only slaughterhouse from August 24 to August 31 and again between September 5 and 9, first on account of Paryushan and then because of other festivals.
The petitioner, Kul Hind Jamiat-Al Quresh Action Committee, filed a petition through its members Danish Qureshi and Mohammed Hammad Hussain Razaiwala that the closure infringes on their fundamental right to food. Razaiwala himself for arguing his case. Justice Bhatt told him that whenever there is any ban, people rush to courts at the last moment. Then while looking at the case papers, the judge commented, “You can restrain yourself for one or two days from eating…”
Raziwala submitted that on a request by one Jaswantlal Shah, the AMC decided to close the slaughterhouse. A representation against the decision for closure was made to the municipal commissioner, he added.
Raziwala also submitted that the high court in December 2021 had made an oral observation that AMC should not try to control the eating habits of the public when AMC had banned Egg and Non-Veg carts on street.
The petition has sought interim relief from the AMC circular on the basis of law, Justice Bhatt asked him to substantiate his case with judgments and posted the matter for hearing on Friday.
