Gujarat HC allows redevelopment of Vasna society; Orders evacuation of dissenting members

Ahmedabad: The Gujarat High Court has paved the way for the redevelopment of Shilpalaya Co-operative Housing Society in Vasna by directing five opposing members to vacate their residences, allowing the majority’s decision for reconstruction to move forward.

The Shilpalaya Co-operative Housing Society, established in the mid-1980s, has initiated redevelopment due to extensive damage since 2014. Facing opposition from just five of its 228 members, the society turned to the High Court after a notice from the AMC’s estate department in 2020 mandated the demolition of unsafe structures. With objections from dissenting members regarding the developer and the redevelopment plan, allegations arose suggesting objections were motivated by illegal constructions. One dissenter, accused of running an unauthorized shop on the premises, was allegedly seeking similar benefits in the new complex.

Justice V D Nanavati acknowledged the urgent need for redevelopment due to building deterioration. Endorsing the developer’s proposal, the judge emphasized benefits to all residents and mandated the evacuation of dissenting members within eight weeks to facilitate redevelopment. DeshGujarat
