GujRERA Suspends Construction & Sale at ‘The Vista’ Residential Project in Vadodara

Vadodara: The Gujarat Real Estate Regulatory Authority has suspended the registration of the ‘Vista Residential’ project by Inbricks Developers in the city and imposed an immediate ban on its marketing, booking, and sale.
The action has left several homebuyers in limbo, with many expressing concern over their investments. RERA has also warned of strict penal action if any bookings or sales are carried out in violation of its order.
Dispute and Legal Background
According to official details, the project is located on Fatehganj Gymkhana Road on land bearing City Survey Nos. 1232 to 1235 and 1243. The development was being undertaken jointly by Majid Khan Pathan and Dolatram Behramji Contractor, who had obtained construction approval from the Vadodara Municipal Corporation in 2022.
However, the land became the subject of a legal dispute between NRI landowner Sudhaben Patel and the developers. The matter reached the Vadodara Civil Court, which ordered maintenance of status quo on the land.
Earlier, the RERA Tribunal had also suspended the project’s licence, stating that since the court had ordered status quo regarding ownership and possession, the builder could not hand over flats to buyers.
Officials said the developers failed to clarify ownership issues despite repeated directions. Consequently, the VMC halted construction and cancelled the previously granted permission, which has not been renewed since.
Despite the ongoing dispute, attempts were allegedly made to proceed with the project. However, the VMC’s construction permission department brought the matter to RERA’s notice, prompting the authority to suspend the project’s registration and impose a complete ban on its sale and promotion.
Police Complaint by Landowner
In June 2024, Sudhaben Patel, an NRI residing in Karelibagh, filed a written complaint with the Police Commissioner against Majid Khan Pathan and others. She alleged that out of her 2,231 sq. m land, only 380 sq. m had been legally transferred, while the remaining portion was encroached upon by the accused.
She further claimed that the developers obtained permissions and launched the scheme despite the disputed ownership. However, no action has been taken on the complaint so far. DeshGujarat
