Flat Sale Violates Disturbed Areas Act in Bhavnagar; Seller, Buyer Booked

Bhavnagar: A case has been registered in Bhavnagar city over the alleged violation of the Disturbed Areas Act (Ashant Dhara) in connection with the sale of a flat in the Juni Manekwadi area, after authorities found that the property transaction was carried out and possession was handed over without obtaining mandatory prior approval from the competent authority.
Based on a complaint filed by Bhavnagar City Mamlatdar and Executive Magistrate K.B. Chandalia, the Gangajaliya police have registered an offence against both the seller and buyer of the property. The accused have been identified as flat owner Chandrakant Bhagwandas Langaliya and buyer Jilani Salimbhai Dholiya.
According to police, the property involved is Flat No. B-10 located on the third floor of Surabhi Apartment on Plot No. 582 (City Survey Nos. 4281 and 4282) in Manekwadi. Authorities stated that Chandrakant Langaliya allegedly sold the flat to Jilani Dholiya through a “sale without possession” agreement executed on March 6, 2025, on a ₹300 stamp paper.
The total value of the transaction was fixed at ₹33 lakh. Of this amount, the buyer reportedly paid ₹30.85 lakh to the seller in installments and was subsequently given possession of the flat.
The alleged violation came to light after an application seeking official permission for the transfer of the property was submitted to the Deputy Collector’s office on April 15, 2026. During scrutiny of the application, officials found that the area falls under the provisions of the Disturbed Areas Act and concluded that both the transfer of the property and the handing over of possession had been carried out in violation of legal requirements prescribed under the Act.
Following the findings, Gangajaliya police registered a case under Sections 6(d) and 9(a) of the Gujarat Prohibition on Transfer of Immovable Property Act, 1991, and initiated further investigation into the matter. DeshGujarat
