Ahmedabad Court Rejects Arvind Kejriwal’s Plea Seeking PM Modi’s Degree Records

Ahmedabad: A city sessions court on Saturday dismissed a revision application filed by former Delhi chief minister and Aam Aadmi Party (AAP) national convener Arvind Kejriwal, who had sought directions to Gujarat University to produce documents related to Prime Minister Narendra Modi’s educational qualifications and degree.
The matter arises from a criminal defamation case filed by Gujarat University against Kejriwal and AAP MP Sanjay Singh over their alleged remarks concerning the university and the Prime Minister’s degree. The complaint was lodged after the Gujarat High Court set aside an order of the Chief Information Commissioner directing the university to disclose Modi’s degree under the Right to Information (RTI) Act.
During the trial before a metropolitan court, Kejriwal had moved an application under Section 91 of the Code of Criminal Procedure (CrPC), requesting the court to direct Gujarat University to produce records related to Modi’s education and the degree awarded by the university. However, the Judicial Magistrate First Class (JMFC) rejected the plea on March 10.
Kejriwal subsequently challenged that order before the sessions court, arguing that the documents were necessary for his defence in the defamation case.
Opposing the revision plea, public prosecutor Sudhir Brahmbhatt and Gujarat University’s counsel Amit Nair contended that the application was not maintainable. They relied on Supreme Court rulings, arguing that an order passed under Section 91 of the CrPC is interlocutory in nature and therefore cannot be challenged through a revision petition.
