Gujarat Assembly passes bill to abolish process fee in courts completely

Gandhinagar: Gujarat assembly today passed The Gujarat Court Fee Amendment Bill 2016 unopposed. The bill was moved by minister of state for law and justice Pradipsinh Jadeja.
The bill proposes to abolish the process fee completely in lower courts and high court in civil and criminal cases.
This will make the process of justice faster and lower down the number of pending cases, said law minister.
Jadeja said ‘Kamgiri hukamo bajanvani fee’ will go with this bill.
It should be mentioned that as per section 32 of Gujarat Court Fee Act 2004, Gujarat High Court was given power to fix the rates of ‘Kamgiri hukamo bajavnidar fee’. Today’s bill proposes to abolish this section.
Jadeja said Gujarat is progressive and speedily developing state. Last year Gujarat government had introduced an option to pay court fees online in attempt to make court procedures speedier. Today the government has proposed to abolish the process fee, thanks to which the cases pending due to process fees will now get clear. As there will be no process fee, the courts will have to send ‘bajavni’ directly to litigants.
Jadeja said this step will complement the ‘ease of doing business’ mission of Gujarat government in connection with merger of court fees and process fee in a single transaction procedure requirement.
