AAP Gujarat leader Isudan Gadhvi arrested in Liquor Prohibition Case; Released on Bail

Gandhinagar: Aam Admi Party (AAP) leader Isudan Gadhvi was arrested by Gandhinagar Infocity Police today. He was later released on bail after required procedures. Two days ago, Isudan was booked by Infocity Police under prohibition act sections 66(1)b and 85(1) after a Forensic report conducted on his blood sample was positive.

The test conducted on Aam Aadmi Party (AAP) leader Isudan Gadhvi to check whether he was drunk when AAP hooligans stormed State BJP headquarters about a fortnight ago. With a positive report backing the allegations that Isudan was actually drunk during protest, First Information Report (FIR) was filed at Gandhinagar Info-city police station.

The FIR draft filed stated: ……. there was an allegation that Isudan Kherajbhai Gadhvi was drunk, following which his medical check up was conducted through the medical officer of civil hospital, Gandhinagar on 20th December. The doctor after primary check up had sent sent blood sample to DFS (Directorate of Forensic Science Services) in sector-18 of Gandhinagar. As per the blood sample alcohol analysis certificate report arrived today at Infocity police station, the presence of alcohol has been found to be 0.0545 W/V……. Accordingly Isudan Gadhavi has been booked under prohibition act section 66(1)b and 85(1).

Police Inspector Pradipsinh Vaghela of Infocity Police Station has become a complainant in this FIR. 

Section 66(1)(b) of the Bombay Prohibition Act 1949 makes any person liable for punishment on conviction for the offence of “consuming, using, possessing or transporting any intoxicant or hemp.” Section 66(2)(b) prescribes a statutory limit of 0.05 percentage of alcohol in the veinous blood taken from the accused.

As per Section 85(1) whoever, in any street or throughfare or public place or in any place to
which the public have or are permitted to have access is drunk and incapable of taking care of himself,
shall, on conviction, be punished, — for a first offence, with imprisonment for a term which may extend to one month and with fine which may extend to two hundred rupees.

Gadhvi and other AAP leaders in connection with the 20th December incident are already booked in earlier FIR under IPC section 452, 353, 354(c), 341, 323, 143, 144, 145, 147, 148, 149, 151, 152, 269, 188, 427, 504, 120, 120b, damage to public property act section 3, 7, epidemic act section 3, and GP act section 135.

The AAP leaders had reached at BJP Pradesh karyalaya Kamlam on 20th December for protest regarding the paper-leak case of head-clerk exam. A female cadre of BJP Shraddha Rajput had alleged the AAP leader Isudan Gadhvi was drunk. Another BJP woman cadre Shraddha Jha who was present at State BJP headquarters during AAP protest there had alleged that there was a smell (of liquor) coming out from a group of AAP protesters. Isudan Gadhvi was taken to Gandhinagar civil hospital for a medical test. His liquor test result fro Forensic Science Laboratory (FSL) turned out to be positive two days ago.

Gadhvi meanwhile claims that he has never consumed alcohol in his life.

The complaint was filed against AAP workers including AAP leader Gopal Italiya, Isudan Gadhvi and others at Info-city police station. The crime was filed for gathering illegally, attacking police and molesting females. The AAP leaders including Gopal Italiya and Isudan Gadhvi were present in the protest at Kamlam. The court had sent them to juidicial custody (Sabarmati Jail) where they stayed behind bars for some 12 days. They were released on bail this week. DeshGujarat
