Gujarat HC fines 14 owners opposing redevelopment of housing scheme

Ahmedabad: The Gujarat High Court on Wednesday dismissed the appeal of 14 families from Surya Apartments (Sola Road) who dissented against the society’s redevelopment plan.
The division bench, consisting of Acting Chief Justice A J Desai and Justice Biren Vaishnav, upheld the order of the single judge to allow the redevelopment plan. The bench also fined the dissenters Rs 25,000 for withholding an affidavit that they had filed before the single judge.
According to the rules, for the redevelopment of a housing society that is over 25 years old and in a state of disrepair, at least 75% of the occupants’ approval is required. In the case of Surya Apartments, 115 out of 132 units had consented to the redevelopment plan, which is more than 75%. However, 14 households objected and approached the High Court claiming that all documents were not supplied to them. However, the High Court on April 11 rejected their application. DeshGujarat
