Ahmedabad: The Gujarat High Court on Saturday allowed the redevelopment of Vardhman Krupa society in the Ghatlodia area of the city by rejecting objections from 50 members and instructing them to vacate their flats. The society, built in 1983, consists of 288 flats spread over 18,000 square metres.

In a notable ruling, the court addressed concerns about mixed residential development as it dismissed objections related to 21 row houses, stating their consent was not required. This decision could help resolve similar redevelopment deadlocks involving a mix of flats, row houses, and bungalows.

The Vardhman Krupa Ghatlodia Co-operative Housing Society had approached the Gujarat High Court as 238 out of 288 members of the society had agreed to the redevelopment through an MoU. As per the rules, a society can proceed with redevelopment if 75% of members agree. In this case, 82% supported the redevelopment. However, around 50 members opposed the plan, arguing that their buildings were structurally sound.

These members, including row house owners, had not given consent, and the treasurer had not signed the resolution. However, since they failed to submit responses during hearings, the HC ordered them to vacate their flats. DeshGujarat
