GujRERA Orders Ahmedabad Builder to Refund Homebuyer With Interest Over Possession Delay

Gandhinagar: The Gujarat Real Estate Regulatory Authority (GujRERA) has ordered Dharmadev Infrastructure Limited to refund a homebuyer’s ₹10.5 lakh along with 11% annual interest after the developer failed to complete and hand over a flat in its Swaminarayan Park-2 project in Vatva.
The order came on a complaint filed by Kalpesh Mehta, who had booked the flat and paid ₹10.5 lakh under a registered sale deed executed on February 11, 2020. Despite the agreed timeline, the developer allegedly failed to complete the construction or hand over possession of the property.
During hearings chaired by GujRERA member M.A. Gandhi, the authority held the developer responsible for the delay and directed it to refund the entire amount with 11% interest from August 9, 2019. The payment must be made within 45 days.
The order also directs the cancellation of the registered sale deed at the developer’s expense after the refund is made.
Notably, the promoter of Dharmadev is Patang Hotel owner Umang Thakkar, who was arrested by Surat Rural police on July 28 in connection with an alleged ₹1.56-crore land scam and cheating case. DeshGujarat
