Taluka court in Gujarat issues Non bailable warrant against Surendranagar MP

Gandhinagar:    A local court in Kalol Taluka town of Gandhinagar district has issued non-bailable warrant against BJP MP from Surendranagar Loksabha constituency in Gujarat, Devjibhai Fatepara in a case related to dishonour of a cheque of Rs 1 crore 48 lakhs and 50 thousands issued by him.
     The next date of hearing of the case had been kept for July 19.
        Advocate of complainant Prabhat Thakor, the former vice president of Gandhinagar district BJP unit, Bhanu Patel today said that the cheque of SBI, Gandhinagar branch was issued by MP Fatepara for returning the money taken by him for from his clinet for contesting 2014 Loksabha election.
    The senior divisional court judge J I Patel had passed the order of non bailable warrant on June 22, the copy of which was obtained today. The order was passed following failure of Fatepara to appear in the court on four consecutive dates last of which was on June 12. The case was filed on October 13, 2016 and the same court had issued a bailable warrant on January 10 this year.
      Patel said that an associate of Fatepara, Thakor had filed the case alleging that the MP had not paid back Rs 1.48 crore lent to him to contest 2014 Lok Sabha elections.he had given the sum to him to contest the polls from Surendranagar constituency on the promise that he will return the money in three months.
   He alleged that when he asked for money after three months, Fatepara sought time for another three months. This way, he did not return the money for six whole months. Later, he offered him some land documents as guarantee but these turned out to be in his wife’s name. He gave him a cheque later saying that it should be deposited when he gives a green signal but later stopped taking calls from Thakor. When he deposited it in the bank it bounced.

He filed the case in Kalol Sessions Court under section 138 of the Negotiable Instruments Act. Court issued repeated summons but he did not reply.

   Patel also said that he has no idea of any offer of out of court settlement by Fatepura till now. The advocate said that no cheating case has been filed against Fatepara and it was only a case of dishonor of cheque.
