Supreme Court upholds right to regulate school fees, suggests corrections in implementation of the act

New Delhi: The Supreme Court has in its order today upheld right to regulate fees in self finance schools. The Supreme Court has taken this decision in response to various petitions pertaining to Gujarat government’s fees regulation act.
‘All schools including CBSE board schools in Gujarat will be impacted by this act. The Supreme court has suggested some corrections. Zonal committees are headed by retired district judge at present. The Supreme Court has asked to appointed retired high court judge in place of retired district judge to head the committees,’ said education minister Bhupendrasinh Chudasama sharing the details of judgement.
‘There’s provision of one retired judge in the state level fee revision committee at present. The Supreme Court has suggested placement of one more retired judge in this committee,’ Chudasama added.
‘These appointments are to be made within a week’ he further said.
Chudasama said, ‘within next two weeks, school operators and parents will need to submit their suggestions after which the State government will announce new slabs and ceilings. Zonal committees will need to decide provisional fees within four weeks after submissions of suggestions from school managements and parents.’
‘The Congress party has exposed. On one hand Congress seeks implementation of this law and on the other side former union Congress minister Kapil Sibal favors commercialization and extend help to petitioners from school management side,’ said education minister Bhupendrasinh Chudasama today in Gandhinagar.
‘The Supreme Court has in its directive nowhere asked to appoint parents in fee regulation committee,’ Chudasama added.
