Chaalo Gujarat: AIANA members raise questions in a letter to Sunil Nayak

Several members of AIANA (USA) have raised number of questions regarding fund utilization in a letter to AIANA President Sunil Nayak who is famous for organizing Chalo Gujarat festival in America.

Members claim that Sunil Nayak has given no response to a letter.

In a statement to media they said, “there has been no response received from Sunil Nayak, AIANA President and therefore, we are releasing these documents for media/press’s knowledge of current status and activities under the banner of AIANA in the U.S. and India.”

Re: American Indian Association of North America (“AIANA”)/Chaalo Gujarat

Dear Sunilbhai and Prafulbhai:

As you are aware, we have been active participants, officers or Members of AIANA since its formation in 2005. Each of us has been involved in Chaalo Gujarat since it was organized in 2006 and have given our time, efforts and money to AIANA/Chaalo Gujarat and the 2006 and 2008 or 2012 events.

We are dismayed to learn that our names no longer appear as such. As leaders in the Guajarati community and in AIANA/Chaalo Gujarat, we all have a need to understand the status and the finances of the organization. Accordingly we have the following questions/comments:

1. What is the current status of the 2012 AIANA Committee?

2. It appears to have been unilaterally dissolved.

(a) Why and who made this decision?

(b) Was any prior notice given to the Committee Members?

3. What is the current status of AIANA as an organization? by the Internal Revenue Service? governmental agencies?

(a) Is it currently a 501(c) (3) non-profit organization qualified and approved

(b) Have all necessary filings and reports been filed with the applicable

(c) Have the necessary Federal Tax returns been filed?

(d) Have the IRS Forms 990 been filed and if so:

(e) When were the forms filed?

(f) Who reviewed the filings?

(g) Did any officers and directors review the filing?

(h) Please provide a copy of all such filings.

4. Are any sales or income taxes due and payable to the State of New Jersey, Division of Taxation or Internal Revenue Service?

5. Have you prepared annual financial statements?

(a) Have you prepared annual expense reports?

(b) Funds were collected in India and in the United States.

(c) Has an accounting been prepared?.

Tickets were sold to the several events. How have the cash ticket sales been accounted for?

7. Sponsorships were sold to the several events.

(a) How have the sponsorships been accounted for?

(b) Were receipts given to the sponsors and charitable donors?

(c) Have you personally received any form of payment or compensation?

(d) If so when and in what amounts?

8. Funds were received from Government of Gujarat to support the event in 2012. How were they expended?

9. What is the status of the 2006, 2008 and 2012 committees?

10. What are the processes to appoint someone to the committee and how is such membership terminated or renewed?

11. Please provide a copy of AIANA’s

(a) Certificate of Incorporation or Certificate of Formation;

(b) By-Laws;

(c) Chart of organizational structure.

12. Have all providers of goods and services been paid?

13. Please provide a copy of all:

(a) Annual tax returns (including Forms 990);

(b) Financial Statement;

(c) Bank Statements;

(d) Certificate of Incorporation or Certificate of Formation;

(e) By-laws;

(f) Chart of organization Structure;

(g) Current list of Committee members, Officers and Directors;

(h) Name and address of accountant for AIANA.

I look forward to your prompt response. If you do not provide the requested information by May 15, 2015, we shall take whatever actions we consider appropriate.
