Gujarat HC clears revamp of Nirmalkunj Society; Orders dissenters to vacate in 8 weeks

Ahmedabad: The Gujarat High Court instructed four dissenting members on Friday to vacate their flats in Nirmalkunj Cooperative Housing Society Ltd in Usmanpura within eight weeks, paving the way for the society’s redevelopment.
The housing society, which is 65 years old, has been in a dilapidated state since the 2001 earthquake. Although repaired by members using assistance from the state government’s earthquake relief fund, the civic body has insisted on repairing three blocks in ruins since 2018, issuing notices to the society twice.
Upon initiation of the redevelopment process by the 18 society members, four objected, and the matter reached the court.
The members advocating for development agreed that over 75% of members had consented to redevelopment, and the buildings exceeded the 25-year age threshold stipulated by law. The dissenting members alleged collusion between certain society members and the developer, claiming that the illicit redevelopment aimed at financial gains for some.
However, the court dismissed these objections, mandating the dissenters to vacate their flats and relinquish possession within eight weeks. DeshGujarat
