RERA Issues Interim Order Against “More Towers” Project in Ahmedabad

Gandhinagar | The Gujarat Real Estate Regulatory Authority (RERA) has issued a significant interim order restraining promoters of the “More Towers” project in Ahmedabad from booking, leasing, selling, or transferring any units until further notice.
The order pertains to a dispute involving the promoters-partners of “Takshashila Air” — Kamlesh Keshav Gondalia and Parthil Kamlesh Gondalia — who are also behind the “More Towers” project being constructed adjacent to “Takshashila Air” near Ellisbridge Town Hall and M. J. Library.
The interim order, passed by a full bench chaired by RERA Chairperson Anita Karwal, also directs that the legal allottees of “Takshashila Air” must not be denied access to their common areas or facilities under any circumstances. “More Towers” is a two-tower residential scheme comprising 386 flats.
Complaint by “Taxshila Air” Allottees
The case originated from a complaint filed by a couple who own two flats (No. 2101 and 2102) on the 21st floor of Tower-A in “Taxshila Air.” They alleged that the promoters illegally diverted common land belonging to “Takshashila Air” into the “More Towers” scheme.
According to the complaint, 4,682.67 sq. m. of land from “Takshashila Air’s” common area was added to “More Towers,” inflating its layout to 11,503 sq. m. for registration purposes. The promoters are also accused of wrongly allocating 631 sq. m. of “Takshashila Air’s” common plot for “More Towers” without the approval of its 196 allottees.
As per rules, “More Towers,” which sits on 6,820.33 sq. m. of land, should have 682.33 sq. m. of common plot area(10%). However, only 477 sq. m. has been reserved, with 205.33 sq. m. allegedly adjusted from “Takshashila Air’s” land.
Allegations of Irregular AMC Approvals
The complainants further alleged that the Ahmedabad Municipal Corporation (AMC) granted layout approval and construction permissions for “More Towers” illegally, based on misrepresented land use. RERA has now directed that a copy of its interim order be sent to the Ahmedabad Municipal Commissioner.
This development has created the possibility of a serious ownership rights dispute between the allottees of “Takshashila Air” and those of “More Towers.” Additionally, concerns have been raised regarding the promoters forming a maintenance body — Sphere Residency Maintenance Service Association — without consulting “Takshashila Air” allottees, allegedly to smoothen the expansion into disputed land.
Case Under Chairperson’s Direct Oversight
Initially heard by a single-member bench, the case has now been escalated due to its seriousness, with RERA Chairperson Anita Karwal personally presiding. After hearing submissions from both the complainants and the promoters, the regulatory body issued its interim restrictions, keeping final orders pending.
The case has sparked attention in Ahmedabad’s real estate sector as it highlights alleged misuse of common areas, irregular municipal approvals, and potential conflicts between existing and new housing projects.
