Gujarat Court orders takedown of defamatory posts against RS MP Nathwani in ₹100-crore defamation suit

Ahmedabad: A local court on Friday ordered the immediate removal of allegedly defamatory content against Rajya Sabha MP and Reliance Industries Limited’s Director of Corporate Affairs, Parimal Nathwani, from social media platforms within 48 hours in connection with a ₹100-crore defamation suit filed by him.
While allowing Nathwani’s plea, the third Additional Senior Civil Judge of the Ahmedabad (Rural) court observed that ad-interim ex parte injunctions in defamation cases are exceptional remedies and can be issued only when allegations are prima facie false, malicious, and capable of causing irreparable damage to reputation. The court noted that Nathwani had established a strong prima facie case, shown that the balance of convenience was in his favour, and demonstrated the likelihood of irreparable harm without immediate judicial intervention.
Nathwani has filed a ₹100-crore defamation suit against seven individuals who run social media channels, online platforms, and other digital communication outlets, alleging that they uploaded, circulated, and broadcast videos, posts, articles, and commentaries containing defamatory accusations against him.
In a social media post, Nathwani stated,”In the ₹100-crore defamation suit filed by me, the Hon’ble Court has ordered the immediate takedown of all defamatory content against me from social media platforms within 48 hours
I have filed a defamation suit of Rs.100 crore against Sanatan Satya Samachar, Sanjay Chetariya, The Gujarat Report, Mayur Jani, Himanshu Bhayani, Dilip Patel, and Bhavin @ Banni Gajera for circulating false and defamatory material about me.
On Friday, the Hon’ble Court issued notice and summons to all the individuals and entities involved. The Court has also ordered the immediate takedown of all defamatory posts made against me, granting me interim protection.
I remain committed to upholding my integrity and will not allow baseless allegations to mislead the public or tarnish my reputation.

Observing that Nathwani has been elected to the Rajya Sabha for three consecutive terms and enjoys significant public credibility, the court said that defamatory content circulated on social media against a person of such stature is likely to harm reputation, diminish goodwill, and seriously undermine public image. It added that malicious publications intended to damage reputation can cause irreversible harm, as loss of reputation cannot be adequately remedied.
It further ruled that a strong prima facie case for urgent interim relief had been made out in view of the reach, virality, and rapid spread of online content, noting that reputational harm cannot be compensated through monetary damages and that continued circulation of allegedly false material would cause serious and irreparable injury.
The court also granted Nathwani liberty to approach the concerned intermediaries under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, seeking appropriate takedown action. These rules aim to enhance the accountability of social media platforms by requiring compliance officers to address grievances and remove unlawful content uploaded on their platforms.
