GUJCTOC Amendment Bill Passed in Gujarat Assembly; Terrorism Provisions Removed

Gandhinagar: Provisions related to terrorist acts have been removed from the Gujarat Control of Terrorism and Organised Crime Act (GUJCTOC) to align it with the new criminal laws enacted by the Central Government, Cabinet Minister Arjun Modhwadia said today.
To further strengthen the law and order situation in the state and to bring the state law in line with the new Central criminal codes, the Gujarat Control of Terrorism and Organised Crime (Amendment) Bill-2026 was passed in the Assembly without opposition.
Explaining the background of the Act and the need for amendments, Cabinet Minister Arjun Modhwadia said the original GUJCTOC law was enacted by the state government in 2015 and contained provisions dealing with both terrorism and organised crime.
He said that after the enactment of the new Central criminal laws, which include strict provisions against terrorist acts, the state government decided to amend the Gujarat law by removing provisions related to terrorism and retaining the focus only on organised crime. He clarified that the basic structure of the the 2015 Act remains unchanged and only necessary modifications have been made for legal alignment.
Modhwadia said that the country has adopted a policy of zero tolerance against terrorism. He noted that the Central Government has replaced the old Indian Penal Code of 1860 with the new Bharatiya Nyaya Sanhita (BNS), 2023, which contains specific provisions related to terrorist acts.
He added that the amendment will also ensure that references to old criminal laws are updated in accordance with the new Central legal framework, including the Bharatiya Nagarik Suraksha Sanhita, 2023, which has replaced the earlier Code of Criminal Procedure.

“(fa) “સંહિતા” એટલે ભારતીય નાગરિક સુરક્ષા સંહિતા, ૨૦૨૩;” |
| કલમ ૨(૨): | “Code” શબ્દ બે જગ્યાએ આવે છે ત્યાં “સંહિતા” શબ્દથી બદલવામાં આવશે. |
| કલમ ૩(૧): | “terrorist act or” શબ્દો હટાવવામાં આવશે. |
| કલમ ૩(૨): | “the commission of any terrorist act or an organised crime or any act preparatory to any terrorist act or organised crime” શબ્દોને બદલે “the commission of an organised crime or any act preparatory to an organised crime” શબ્દો મૂકવામાં આવશે. (અર્થાત્: “કોઈ આતંકવાદી કૃત્ય અથવા સંગઠિત ગુનાના કમિશન અથવા કોઈ આતંકવાદી કૃત્ય અથવા સંગઠિત ગુનાની તૈયારીના કોઈ કૃત્ય”ને બદલે “સંગઠિત ગુનાના કમિશન અથવા સંગઠિત ગુનાની તૈયારીના કોઈ કૃત્ય” મૂકવામાં આવશે.) |

| કલમ ૯(૨): | “in sub-section (1) of section 260 or section 262 of the Code, try the offence in a summary way in accordance with the procedure prescribed in the Code and the provisions of sections 263 to 265 of the Code” શબ્દોને બદલે “in sub-section (1) of section 283 or section 285 of the Sanhita, try the offence in a summary way in accordance with the procedure prescribed in the Sanhita and the provisions of sections 286 to 288 of the Sanhita” શબ્દો મૂકવામાં આવશે. |
