GujRERA refers Shivalik Wave project case for legal action over pre-registration marketing

Ahmedabad: The Gujarat Real Estate Regulatory Authority (GujRERA) has referred a case involving the 32-storey Shivalik Wave project to its secretary for legal action against the developers, who are accused of promoting and booking units before obtaining official RERA registration.
The complaint was filed by Gandhinagar resident Devarshi Parikh against promoters Chitrak Shah and Anil Desai. Parikh alleged that the developers began marketing the project—located near Vaishnodevi Circle—prior to its registration with RERA. He also claimed he was promised a 1% brokerage (amounting to ₹3.5 crore) for providing details of the 13,500 sq yard plot to the Shivalik Group, but the amount was never paid.
Regarding the unpaid brokerage, GujRERA ruled that the matter constitutes a civil dispute and falls outside its jurisdiction, as Parikh is not a registered stakeholder under the Act. However, the authority upheld the charge of pre-registration marketing after reviewing promotional material submitted by Parikh, which featured the Shivalik Group’s name and contact details but lacked a RERA registration number or website.
