One of the arguments of Tathya’s lawyer was that there was dark on the ISKCON bridge at the time of the accident and Tathya couldn’t see the persons standing on the road. However, as per the EDR report OKayed by Jaguar company’s headquarters in the U.K., the lighting system of the car was fully functional and throwing sufficient light to spot the persons on the road when the accident happened.
As per the EDR report, the car was technically perfect and it had no fault at the time of the accident. The accused Tathya will not be able to make an argument that there was some issue in the brake or the car because of which the gruesome accident took place.
The video evidence has been collected by the Police, showing that Tathya himself was driving the car when the accident happened. The car had five passengers capacity however six persons were sitting inside at the time of the accident. Of six persons inside the car including Tathya in the driving seat, four have recorded their statements under section 164 in the court as witnesses, in addition to 3 eyewitnesses who were on the spot at the time of the accident.
