Police ads IPC section 308 in FIR against Tathya Patel

Sabarmati: The city police have decided to add IPC section 308 against SG highway accident case accused Tathya Patel. The city Police today announced that it is going to file a chargesheet in this case on Thursday in court. Police said the driving license of Tathya Patel is going to be canceled by RTO. Police said DNA report is also arrived and it favors the case. These details were shared by ACP traffic Narendra Chaudhary. He also added that a major drive against traffic violation shall be initiated from SG road, CG road, Judges bungalow road and Naranpura cross road to Shatrinagar to Gujarat High Court stretches.

Section 308 in The Indian Penal Code
Attempt to commit culpable homicide.—Whoever does any act with such intention or knowledge and under such circumstances that, if he by that act caused death, he would be guilty of culpable homicide not amounting to murder, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both; and, if hurt is caused to any person by such act, shall be punished with imprisonment of either description for a term which may extend to seven years, or with fine, or with both. Illustration A, on grave and sudden provocation, fires a pistol at Z, under such circumstances that if he thereby caused death he would be guilty of culpable homicide not amounting to murder. A has com­mitted the offence defined in this section.
