New Delhi: President of India has given assent to “The Gujarat Ownership Flats (Amendment) Act Bill”.

The bill, passed by the Gujarat Assembly in monsoon session last year proposed to permit redevelopment of buildings that are over 25-years-old with the consent of 75% of members. Earlier, consent of 100 per cent of the members was required.

Once notified, the Act will provide relief to members of old societies pending redevelopment as the earlier law required consent of 100 per cent of the members.

Pradipsinh Jadeja, minister of state for home, law & legislative affairs said, “The President has approved the Gujarat Ownership Flats Redevelopment Bill. Now the state government will soon start implementation of the new act.’’

The ‘statement of objects’ section of the Bill reads – “While implementing the provisions of the said Act, it has been noticed that certain buildings covered by the said Act, though require re-construction or re-development, it was not possible to undertake such reconstruction or redevelopment as the consent of all the members of the residents of the said flat or the apartments building, as the case may be, was required. It was also been noticed that if such buildings were not re-constructed or re-developed in time, there is a likelihood of risk of life to the residents thereof. With a view to overcoming such problems , it was considered necessary to amend the said Act suitably.”
