8 held for ‘illegal and brutal’ slaughter of camels on eve of Bakra Eid

Bhuj: Vayor Police in Kutch (West) has booked 8 persons for allegedly killing of two camels in Thumdi village of Abdasa Taluka on the eve of Bakra Eid in violation of laws. The camels were killed for a feast of meat on the day of Bakra Eid.

Vayor police has filed crime against Jafar Amad Sumra, Haji Hussain Adham Sumra, Haji Hasman Ismail Sama, Amad Kasam Halepautra, Hanif Jakab Sumra, Natha Mamad Abda, Ali Hussain Khalifa, Kadar Ali Gajan. They were all detained. The accused are from Thumdi, Vagoth, Ber Nani and Charopdi mot villages of Abdasa taluka in Kutch (West).

Police also recovered sharp tools, rope etc. from the place of crime.

The accused are booked under IPC section 429, 268, 114, The Prevention of Cruelty to Animals Act 11(1)(i), Gujarat Animal Preservation Act 1954 section 3 (b) and Gujarat Animal Preservation Rules – 1967, section (3) that mainly pertain to brutal illegal killing of two camels in public without taking any permission from relevant officer or a certificate obtained for the same.

Section 429 in The Indian Penal Code:
429. Mischief by killing or maiming cattle, etc., of any value or any animal of the value of fifty rupees.—Whoever commits mis­chief by killing, poisoning, maiming or rendering useless, any elephant, camel, horse, mule, buffalo, bull, cow or ox, whatever may be the value thereof, or any other animal of the value of fifty rupees or upwards, shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both.

Section 268 in The Indian Penal Code:
268. Public nuisance.—A person is guilty of a public nuisance who does any act or is guilty of an illegal omission which causes any common injury, danger or annoyance to the public or to the people in general who dwell or occupy property in the vicinity, or which must necessarily cause injury, obstruction, danger or annoyance to persons who may have occasion to use any public right. A common nuisance is not excused on the ground that it causes some convenience or advantage.

Section 114 in The Indian Penal Code:
114. Abettor present when offence is committed.—Whenever any person, who is absent would be liable to be punished as an abettor, is present when the act or offence for which he would be punishable in consequence of the abetment is committed, he shall be deemed to have committed such act or offence.

Section 11 in The Prevention of Cruelty to Animals Act, 1960
11. Treating animals cruelly.—
(1) If any person—
(a) beats, kicks, over-rides, over-drives, over-loads, tortures or otherwise treats any animal so as to subject it to unnecessary pain or suffering or causes or, being the owner permits, any animals to be so treated.
