Surat AAP councilor, aide nabbed for wrongful restraint, confinement

Surat: Kapodra Police on Wednesday nabbed Aam Aadmi Party (AAP) corporator Dharmendra Vavaliya and others for stopping the city-buses to inquire about their fitness certificate in Surat.

A driver of city-bus in Surat named Rahul Krishna Rokade filed a complaint at Kapodra Police Station against AAP Corporator Dharmendra Vavaliya and others for causing traffic-jam by illegally stopping the buses.

As per the complaint, a man driving an i20 car had stopped the city-bus along with other person, both wearing Aam Admi Party’s cap, when the bus was passing through Kapodra area after crossing Kapodra Utran Bridge. A person from i20 car later introduced himself to the complainant as AAP corporator and said that he will not allow the bus to proceed further till they don’t show him the fitness certificate of the bus. Other seven to eight buses were also stopped in the same manner.

The complainant then called his superior Mihnaz Mubarak Patel who reached at the spot and showed the fitness certificate of all the buses. However even after showing fitness certificates of the buses, AAP councilor and his aide illegally stopped the bus and didn’t allow it to move. The passengers were also offloaded from the bus,

A mob had gathered and started brawling at the spot consequently. Kapodra Police has filed a crime against AAP Corporator Dharmedra Vavaliya and others considering the complaint and nabbed them.

Police has booked Vavadiya under IPC sections 341, 342 and 114.

Section 341 in The Indian Penal Code
341. Punishment for wrongful restraint.—Whoever wrongfully restrains any person shall be punished with simple imprisonment for a term which may extend to one month, or with fine which may extend to five hundred rupees, or with both.

Section 342 in The Indian Penal Code
342. Punishment for wrongful confinement.—Whoever wrongfully confines any person shall be punished with imprisonment of either description for a term which may extend to one year, or with fine which may extend to one thousand rupees, or with both.

Section 114 in The Indian Penal Code
114. Abettor present when offence is committed.—Whenever any person, who is absent would be liable to be punished as an abettor, is present when the act or offence for which he would be punishable in consequence of the abetment is committed, he shall be deemed to have committed such act or offence.

It’s worth noting that the Central government has ordered CBI inquiry in purchase of 1,000 low-floor buses by Kejriwal government in AAP ruled Delhi. Delhi government run DTC buses are running into losses of over Rs.1,000 crore annually since 2015. Recently for the first time, entire bus fleet operated by AAP government ruled Delhi’s DTC was declared ‘overage’.
