Gandhinagar: As many as 47 Town Planning (TP) schemes of Ahmedabad city are pending for government approval in two years period of 2023 and 2024.

The government shared the list of pending TPs in reply to a question asked by the city Congress MLA in the State assembly. The government in its reply further stated that no time-limit can be decided for decisions on pending approvals/disapprovals.

Regarding the reasons behind pendancy, the Government in its reply stated that –

Considering the various representations received regarding the draft plan, justice has to be done and the interests of the landowners have to be protected.

As per the provisions of the rules and regulations by the authority, a draft plan is prepared by obtaining objections and suggestions from the landowners after explaining the plan in the owners’ meeting. The authority submits the draft town planning scheme along with the original submissions and other relevant documents to the state government for approval under section-48 of the Act, 1976. After examining the submitted draft plan and its documents, considering the objections and suggestions received by the state government regarding the plan, there is a provision to approve/reject or return the plan. Therefore, a time limit cannot be fixed for the state government to approve the scheme.

After the necessary action by the Town Planning Officer, the scheme is submitted to the State Government for approval under section-64 of the Act, 1976. In this town planning scheme, the state government has to check for defects, illegalities, and irregularities etc. as per the provisions of the law. In addition, in each town planning scheme, a decision can be taken in relation to the representations made by the landowners of that area and the scheme can be approved/rejected as per the provisions of the law. Therefore, a time limit cannot be fixed for the state government to approve the scheme.
