AMC councillor Zubair Pathan likely to be disqualified over birth of third child

Ahmedabad: Zubair Pathan, a councillor of the Amdavad Municipal Corporation (AMC) from AIMIM, is likely to be disqualified from the civic body due to the birth of his third child, which violates municipal regulations. As per election rules, a councillor cannot contest elections if they have more than two children. If a third child is born after being elected, they become ineligible to continue in office.
Pathan had two children when elected, but after welcoming a third child in October last year, a complaint was filed with the AMC. In response, the AMC issued a show-cause notice, asking him to clarify the matter.
It is learned that the AMC administration is prepared to take action following Pathan’s response. A formal complaint, supported by evidence, has demanded his disqualification. The municipal secretary has since sought clarification from Pathan.
The final decision on Pathan’s councillorship now lies with the Municipal Commissioner, who is expected to rule on the matter soon. As per Section 10 of the Gujarat Provincial Municipal Corporation (GPMC) Act, under the Gujarat Local Bodies Amendment Act-2005, a councillor is not disqualified unless their number of children increases after the election. Since Pathan’s third child was born post-election, experts believe his position is in jeopardy.
