Gujarat HC junks another plea against road-widening plan near Motera Stadium

Ahmedabad: The Gujarat High Court has dismissed a petition by 29 residents of Baldevnagar in Acher challenging the Ahmedabad Municipal Corporation’s (AMC) eviction order issued for a road-widening project leading to the Narendra Modi Stadium in Motera, part of preparations to boost sports infrastructure for a potential 2036 Olympics bid.

This is the second time such a plea has been rejected. Earlier, in September, 49 residents from the same locality had also failed to secure relief.

AMC informed the court that Town Planning (TP) Scheme No. 23, finalised in 1984, mandates a 24-metre-wide road through the area and that eviction is necessary for its implementation. Residents argued that the road plan would affect nearly 100 fully developed properties, questioned AMC’s powers under the Town Planning Act, and said the land was marked as a Slum Clearance Zone under another statute.

Justice J. L. Odedara observed that once a TP scheme is sanctioned, land vests with the planning authority and private development requires prior approvals, none of which the petitioners possessed. The court directed residents to hand over vacant and peaceful possession as ordered by AMC.

The court allowed them to seek alternative accommodation and granted a two-week stay on the order to enable an appeal. DeshGujarat
