Gujarat HC clears way for TP scheme road near Motera Stadium; dismisses plea against eviction

Ahmedabad: The Gujarat High Court’s division bench on Monday rejected an appeal filed by 29 residents of Baldevnagar (Acher) in Sabarmati, who had challenged the eviction notices issued by the Ahmedabad Municipal Corporation (AMC). The bench upheld the single-judge order delivered on November 14.
The AMC had served eviction notices to clear land for the construction of a 24-metre-wide road mandated under the 1984 Town Planning (TP) scheme. The residents contended that they had lived there as tenants for several decades, paid taxes, and held utility connections, and that the eviction notice was issued only in 2025, 41 years after the scheme was sanctioned. The development is believed to be linked to future infrastructure upgrades amid India’s interest in bidding for the 2036 Olympics.
The court noted that the petitioners had no legal documents proving ownership of the land or the structures. It stated that while they were free to seek rehabilitation from the appropriate authorities, they could not obstruct the execution of a long-pending TP scheme.
The court dismissed the plea to cancel both the eviction notice and the TP scheme, relying on established legal precedents, and reaffirmed the need to implement the finalised plan. DeshGujarat
