CBI court convicts three in Surat excise duty rebate fraud case

Ahmedabad: A CBI court here has convicted and sentenced three individuals Samir Fateh Mohammad Immamudin (absconding), Tejas Arvindbhai Desai, and Amit Murarilal Gupta to three years’ imprisonment along with a fine of Rs 50,000 each for fraudulently availing excise duty rebate.
The Central Bureau of Investigation (CBI) registered the case on February 20, 2009, against M/s Shree Sai Impex, Surat, and its associates, including Rafaliya Ghanshyam Gordhanbhai and Tejas Desai, along with other unknown persons.
According to the CBI, the accused entered into a criminal conspiracy and fraudulently claimed rebates by submitting forged documents as genuine export records related to M/s Shree Sai Impex. They allegedly obtained a total rebate of Rs 1,18,39,833 through 51 rebate claim applications, causing a corresponding wrongful loss to Central Excise authorities in Surat.
After completing the investigation, the CBI filed a chargesheet on November 30, 2009, against the accused persons, Samir Fateh Mohammad Immamudin, Ghanshyam Gordhanbhai Rafaliya, Tejas Arvindbhai Desai, and Amit Murarilal Gupta.
The court, after trial, convicted Samir Fateh Mohammad Immamudin, Tejas Arvindbhai Desai, and Amit Murarilal Gupta, and sentenced them accordingly. Meanwhile, accused Ghanshyam Gordhanbhai Rafaliya died during the trial, following which the proceedings against him were abated by the court. DeshGujarat
