Amit Shah didn’t appear in Ahmedabad court, next hearing on 21st
Ahmedabad, 13 June, 2011

Amit Shah, former Minister of State(MoS) for Home, was summoned by CBI special court in Ahmedabad on June 13 in connection with the Sohrabuddin Sheikh fake encounter case. However Shah didn’t come to Ahmedabad today. The court will be hearing the case on 21st June now.
Last month AY Dave, the designated judge of a CBI special court had issued summons to Amit Shah, former Minister of State (MoS) for Home, to remain present on June 13 in connection with the Sohrabuddin Sheikh fake encounter case to start the trial process in the highly controversial case.
While issuing the summons to Shah, the judge had observed that, the trial in the case should begin by now as the case has been pending for four months.
The judge had also clarified that Shah has to appear before the court after getting prior permission from the Supreme Court which had directed him from entering Gujarat.
The Supreme Court’s ban on Shah entering Gujarat came after the Central Bureau of Investigation (CBI) challenged the bail given to him by the Gujarat high court four months ago. Sources connected to the case explained that, by issuing summons to Shah, the judge has started formal procedure to send the case before the Additional Sessions Judge’s court so that trial can begin in the same.
As part of the judicial process it is mandatory for the court to hear all the accused before starting the trial in a case.
The trial may start in a couple of months as chargesheets have already been filed against the accused including Shah.
IPS officers DG Vanzara, Rajkumar Pandiyan, Abhay Chudasama, Rajasthan IPS officer Dinesh MN along with several other cops have been locked behind bars for over 2 years in connection with the case.
CBI opposes case trial in Gujarat
Opposing the move to send the case for trial to an Ahmedabad court, CBI counsel Ejaz Khan said that an application for the transfer of trial outside the state was pending before the Supreme Court.
He said that till the agency’s application was pending in the apex court, the case should not be sent for trial in any court in the state.
Khan said that two accused in the case – Ajay Patel and Yashpal Chudasama – were still to be arrested.
He also referred to fears of attempts to influence the trial, andsaid former Gujarat minister Amit Shah, an accused in the case, had been barred by the apex court from entering the state.
