Ahmedabad, 22 November 2011
The Chief Justice of Gujarat High Court today evening appointed Justice V.M.Sahai as third judge to hear Gujarat Lokayukta appointment case.
Justice Sahai’s decision will be decisive in this case, because two judges who heard this case, earlier delivered split verdict.
The case is about Gujarat governor Dr. Kamla Beniwal’s unilateral decision to appoint retired Justice R.A.Mehta as new Lokayukta of Gujarat. without consulting the council of minister which is unconstitutional as per the state government whose minister of state for Law and Justice Pradipsinh Jadeja is petitioner challenging Lokayukta appointment.
R.A.Mehta has not taken oath after his appointment, apparently due to the court case going on.
Fresh hearing of the case will be held tomorrow in the afternoon.
