A case of drink and drive and accident against Vismay Shah was also filed in year 2011 at Sarkhej Police station in Ahmedabad. Even in this case for which Vismay has been sent to jail today, the fact is that Vismay’s BMW had first hit an Accent car and therefore his BMW was being chased by that Accent car. Vismay’s BMW hit two boys on bike when his focus was on side mirror and rear mirror to see the status of Accent car that was chasing his BMW. Two boys on bike died. A person on driving seat in Accent car is witness number 07 in this case.
Victim Rahul’s father Ghanshyambhai said, this verdict is due to right investigation done by Police from day one. He said advocate Shukla and Bharatbhai helped us a lot.
When asked about hostile witness Lalit Gupta, Ghanshyambhai’s lawyer Rajubhai Shukla said, “Lalit Gupta is poor person who lives in rented house. His father runs loading rickshaw. He had came to my office to ask me that I should not appear before court on behalf of him. I told Lalit that lower and higher court have rejected Vismay Shah’s discharge plea. I also told Lalit that he had given statement before magistrate and if he backtracks he may face actions similar to Zahira Sheikh case. I warned him not to turn hostile in this case, but he didn’t listen to me. Now he is likely to get two year sentence for turning hostile for some money. It was Judge MR Shukla who appeared before court and said that statement under 164 was given in court and it was correct.
Victim’s father Ghanshyambhai said, “we don’t want compensation. We fought this case because we wanted to set an example. We didn’t want same to happen to other persons. We wanted to show red signal against speedy and risky driving.”

Ghanshyambhai’s lawyer Shukla said, “We are not going to accept the compensation offered by court. We are going to High Court to seek proper compensation. Whatever decision taken there will be accepted to us.”
Shukla said, “we think 5 years term is not enough.”
Even another victim boy Shivam Dave’s father Premshankarbhai said that the sentence was not enough and only 10-year prison could set an example.
Mitesh Shah, one of witnesses who stood by his statement and didn’t turn hostile said he decided to continue to tell truth because he too had children and he saw his children in victim boys. He said when he was for the first time summoned to appear in court to give statement he conveyed a person that he was in Mumbai. For two days he continued to think that whether he should go to the court as witness or not. Even his relatives were of opinion that he should stay away.
Meanwhile Vismay Shah was sent to Sabarmati jail today evening. His mother accompanied him right upto the gate of jail. Holding mineral water bottle in hand, Vismay was obviously looking upset.
