Gujarat HC dismisses PIL seeking instruction to govt on reservation
March 30, 2016
Ahmedabad
The Gujarat High Court today dismissed a Public Interest Litigation (PIL) which sought instructions to the central government to make available the details of caste based Socio-Economic Caste Census-2011 report to the state government and other concerned authorities for its proper analysis before any new inclusion or exclusion in the list of castes under reserved category.
The court of Chief Justice R S Reddy and Justice V M Pancholi rejected the PIL saying that at this juncture it can’t be assumed that the government won’t do proper analysis of the data.
Advocate of the petitioner Zakir Hussein S Seikh, Mr. Amit Panchal said that as the said caste based census report which was handed over to the union government in 2015, has not yet been brought in full public domain and has not even been shared with the state governments. My client had contended that unless a proper analysis of the recent caste based data was done there should not be any new inclusion or exclusion in the list of castes under reserved category.
To a query Mr. Panchal said that he had not named Patidar/Patel or any other caste in his petition.
