Ahmedabad: The Gujarat High Court today rejected the petition of Vismay Shah, the accused of a seven year old sensational hit and run case in the city and maintained the lower court punishment of five years jail term and fine.
The court of Justice Sonia Gokani has also ordered Vismay, a young brat from a wealth family, to remain present for execution of the punishment in four to six weeks.
Two motorcycle borne youths, Rahul Patel (25)and Shivam Dave (21), were killed on February 24, 2013 when his luxury BMW car hit them. He had surrendered before the police after three days.
The court of ADJ P M Patel had on July 2015 pronounced his judgement in this case sentencing five years jail term and Rs 25 thousand fine to him. Along with it the court had also ordered him to pay Rs five lakh each to the family of the two deceased. Vismay was later released on bail. He had challenged the lower court verdict in the high court.
He was also caught from a liquor party along with wife and friends in December 2018. He was again jailed in that case the high court later granted him bail on condition of social service. Prior to that he was also caught with mobile phone in the jail.
Earlier, the father of one of the deceased Rahul had submitted in the court that he did not want to pursue the case as he had struck a compromise with Vismay. But the brother in law of the second deceased Shivam who appeared on behalf of his ailing father informed the court that he did not want to compromise with the accused. The government counsel had however opposed Vismay’s plea arguing that there should be no pardon for him as it would set a bad precedence.
Earlier the Gujarat high court had deferred the pronouncement of its judgement on the order several times.
Meanwhile, it was highly likely that Vismay would file another appeal in this matter in front of a larger bench or the supreme court.
