August 20, 2020
Ahmedabad: With a notion to give thrust and clear the path for “Ease of Doing Business”, the Government of Gujarat has adopted a revenue amendment in the Ganot Dhara (The Gujarat Tenancy and Agricultural Lands Act) of the state.
This decision was taken during the customary weekly meeting of Gujarat Cabinet held in Gandhinagar on Wednesday.
According to this decision of the Gujarat Cabinet, the institutions such as Agriculture University, Animal Husbandry University, medical and engineering colleges, and others would not require a prior permission from the district collector for the land purchased for the educational purpose.
As a result of this decision of the Chief Minister, Gujarat would get more developmental opportunities in the fields of agriculture, animal husbandry, education, health and others. Not only this, it would also attract more industrial investment in the state.
Now, after the purchase of such land, the collector can be informed within one month and after acquisition of necessary certificates, just like Bonafied Industrial Purpose, the project can be started in the fixed time frame.
Accordingly, if the land is purchased for the Bona-fide Industrial Purpose but cannot be used for industrial purpose, in such cases under the provisions of GDCR, the land can be sold for other purposes than industrial purpose.
In such cases, after obtaining the certificate, 100 % for 3 to 5 years, 60 % for 5 to 7 years, 30 % for 7 to 10 years and 25 % after 10 years can be sold as per the cost rate mentioned in the prevailing cost-table.
In case of such lands, merger of the company, joint venture, amalgamation or sale of land transferred to its own subsidiary, Group Company or associate company will not be considered as transfer. In such transactions, transfer can be done by paying only 10 % amount of the existing cost-table (Jantri).
In the cases of debt-recovery, auction through NCLT, liquidators or financial institutions, the buyers of such land will have to pay only 10 % premium of the existing cost within 60 days from date of the auction order.
The Cabinet decision will ease the many of the difficulties faced by the industrial entrepreneurs. The decision will be one more milestone in the many initiatives taken by the Chief Minister for smooth-transparent and clean administration of revenue processes in the state.
The solving of the issue of agricultural lands purchased by the entrepreneurs will make it possible efficiently use such land and will also generate new opportunities of development and employments.
