Gujarat High Court to check constitutional validity of liquor prohibition

Ahmedabad: Gujarat High Court will decide whether the liquor prohibition in Gujarat is constitutionally valid or not.

According to lawyer Deven Parikh said: the petitioner had argued that in last five-seven years, the Supreme Court has interpreted the constriction in different way and raised various dimensions related to human liberty. A person should have freedom regarding what to eat and what not to eat, what to drink and what not to eat, in such a way that society would not face negative impact.

The government opined that the issues questioning liquor prohibition by a petitioner raised are covered under the earlier Supreme Court judgement. So the Supreme Court had given a judgement already and therefore Gujarat High Court has nothing to do in this regard.

The Gujarat High Court has rejected this argument. So now Gujarat High Court will decide whether the prohibition law is valid or not as per constitution. So Supreme Court’s rules upheld in 1951 are not relevant or binding today as various aspects are yet to be checked for constitutional validity.

Today’s High Court decision makes it clear that this matter has to be seen afresh. DeshGujarat
