VMC shuts Aatapi Ajwa Theme Park for breach of agreement; serves notice

Vadodara: Vadodara Municipal Corporation(VMC) has ordered Arved Ajwa Theme Park Ltd to shut all rides of Aatapi Wonderland for breach of agreement. VMC has served notice and asked the company who not to abolish the agreement due to its breach. The notice has to be replied within next 10 days by the company.

The company is led by Cube Construction fame Sanjay Shah. Earlier VMC had also taken back the land leased to Ajwa Nature Safari Park Pvt Ltd for development of Safari Park which eventually was not developed by the company.

VMC had signed MoU with theme park pvt ltd company on Design, Build, Operate, Transfer (DBOT) basis on 30th December 2016. The land given to company is 70 acres in size or 2,83,280 sqm. It was decided in agreement that the company would pay Re. 1 per sqm to VMC as annual license fee.

Aatapi was charging Rs. 30 entry fee plus GST per ticket as per MoU, but then was also charging Rs. 300 for rides through various packages. The accounts of such income were not shared with VMC. Moreover Aatapi had also developed a hotel and party plot for which VMC was not consulted. The company had also not deposited over Rs. 17.13 lakh annual license fee and Rs. 47.50 lakh annual premium fee.

VMC had first served notice on 8 December 2022 and later served 18 notices till 25 October this year. Now the last notice has been served asking the company why agreement should not be considered cancelled. All rides are ordered to shut. The hotel, party plot are also shut.

As per clause 27.1 of MoU, the company was required to present its annual balance sheet every year in VMC with all data of revenue. However such reports were not submitted, following which VMC itself carried out audit. Some other clauses that are breached include bank guarantee, complain register report, insurance copy, tri-monthly fee statement, fire license copy, R&B fitness certificate of rides, electric inceptor certificate, site license deed’s annual fee and penalty over that, ticket rates and more.
