Navrangpura society moves to Gujarat HC over redevelopment dispute
July 26, 2024
Ahmedabad: Meghalaya Avenue Housing Society Ltd in Navrangpura has moved to the Gujarat High Court after six of its members opposed the redevelopment process.
The society is around 50 years old and has 84 members. After obtaining consent from over 75% of its members, the redevelopment process began. However, six dissenting members have expressed objections to the redevelopment terms and the proposed size of the new flats.
It is learned that one of the dissenters has unlawfully encroached on society land and expanded his 2BHK flat into a 4BHK by constructing two additional rooms. This individual now demands a larger carpet area in the new development, claiming that he will be losing his expanded flat. The society called this demand unreasonable and stated that the encroacher should not be allowed to influence the redevelopment. With this dispute, the redevelopment project has been halted, prompting the society to seek judicial intervention.
Following a preliminary hearing, Justice Sangeeta Vishen has issued notices to the Ahmedabad Municipal Corporation (AMC), the developer, and the six dissenting members. The court has scheduled the next hearing for August 22. DeshGujarat
