Housing Society in Paldi approaches Gujarat HC against illegal temple construction by non-members

Ahmedabad: The Shardanagar Cooperative Housing Society, located in the Paldi area, has approached the Gujarat High Court seeking the demolition of a temple being constructed on society land by non-members.

The petition of the residential society has requested the court to halt the allegedly illegal construction of the religious structure without permission.

The society’s counsel told the court that society had earlier reported the illegal construction to the AMC, but the civic body only issued notices to Ajay Kothari and Ashok Sheth, the individuals involved in the building. It was claimed that no proper authorization was obtained for the construction.

The counsel further stated that the land belongs to the residential society, and its members only own the superstructures. Kothari and Sheth reportedly purchased bungalows from their owners and commenced the temple construction. Being non-members, they do not hold official plots. The construction on plot numbers 54 and 55, also violates the society’s bylaws, as no member can hold more than one plot, and merging plots is not allowed.

After the hearing, Justice Sangeeta Vishen issued notices to the AMC and other respondents, seeking their responses by August 29 and ordering the immediate halt of construction. DeshGujarat
