RERA suspends construction, sale of ‘The Vista’ residential project in Vadodara

Vadodara: The Gujarat State Real Estate Regulatory Authority (Guj RERA) Tribunal has suspended the construction and sale of flats in ‘The Vista Residential’ project by Inbricks Developers in the city.

Sudhaben Jashvantbhai Patel, a resident of Karelibaug, Vadodara, filed a complaint against Majidkhan Pathan, the proprietor of Inbricks Developers, with RERA. In her complaint, Sudhaben claimed ownership of the land where ‘The Vista’ residential project is being developed in Fatehganj. She alleged that the builder fabricated false documents for the land and got the project approved by RERA. Additionally, it was mentioned that the builder also fraudulently obtained a construction approval letter from VMC.

According to the information presented in the case, the Tribunal noted that the builder had obtained the RERA project approval based on the construction approval letter from VMC in October 2022. However, the case related to the land where the project is being built is currently ongoing in the Vadodara Civil Court, and the court has issued a stay on it.

The Tribunal’s judgment stated that since the court has ordered the maintenance of the status quo regarding the land ownership and possession, the builder cannot hand over possession of flats in the project. Therefore, the registration granted to the builder for ‘The Vista’ project is subject to reconsideration.

VMC has also canceled the construction approval letter and imposed a ban on further construction. Until RERA Authority issues a new order, the builder is prohibited from booking or selling any new units in this project. DeshGujarat
