Housing society transfer fees in Gujarat limited to ₹1 lakh; new rules notified

Gandhinagar: Over a year after the Gujarat Co-operative Societies (Amendment) Bill, 2024 was passed in the state assembly, the Gujarat government has issued final rules regarding transfer fees for properties in cooperative housing societies.
Effective from June 10, the new rules cap the maximum transfer fee at ₹1 lakh and prohibit societies from charging any development fees. In February, the state government had published draft rules and invited public feedback. According to officials, no major objections or suggestions were received.
As per the Gujarat Co-operative Societies (Amendment) Rules, 2025, now notified through the gazette, cooperative housing or housing service societies may charge a transfer fee not exceeding 0.5% of the property’s consideration value or ₹1 lakh—whichever is lower. Furthermore, no transfer fee can be collected in the case of property transfers to legal heirs where no monetary transaction is involved.
The rules also explicitly bar housing societies from collecting any additional amounts—whether for development charges, donations, or contributions to other funds—under any pretext during property transfers.
