Central govt returns GUJCOC seeking three amendments

The union cabinet Friday returned Gujarat’s anti-terror act, Gujarat Control of Organised Crime(GUJCOC) Act, seeking three amendments before it could be recommended to the president for acceptance.
“Under the proposed Gujarat Control of Organised Crime Act, a confession before a police officer is admissible in a court. This should be made inadmissible,” Home Minister P. Chidambaram told reporters after a cabinet meeting presided over by Prime Minister Manmohan Singh.
“The act also contains a clause stating that a court cannot grant bail if the public prosecutor opposes it. The court should have the power to grant bail even if the public prosecutor opposes it,” Chidambaram said.
The third amendment related to section 20 (2) of the act that the home minister did not specify.
“Once these amendments are effected, the cabinet will be in a position to recommend to the president to grant assent to the act,” Chidambaram said.

GUJCOC can be abused badly if it may have provision that confession before a police officer is admissible. If public prosecutor can deny the bail, what is the need of court and judge ?
These strict rules are fine as long as they are used against anti-national terrorists but just imagine corrupted police abusing GUJCOC against common people for their gains. It can be really dangerous.
I’m sure there will be proper context attached with execution of such strict provision in GUJCOC but Cetnral govt is playing clever here and displaying only things they want everyone to see. If there are no context, GUJCOC is too harsh law to be provided and Police can easily violate basic human rights using this law.
Fake Gujarati /Imposter/Asali-naqli – Removing these provisions would enable Islamic terrorists commmit any crime and go scot free just liek Kasab is doing after 26/11 mumbai killings. Given we have lsot more people and security forces to Terrorists than all the wars with our enemies, We can live with the 0.0001 possibiliy o fmisuse becusae such misuse won’t be futile..it would prevent indian muslims from becoming terrorists.

Yes Understood your concerns, and yes GUJCOC is indeed dreadful especially when you see the horrors practiced during the days of TADA by the goondaraj Kangress.
But when the crimes get equally dreadful like the burning of train in Godhra, or the riots, or the mafia operating freely with a team of lawyers, then you need such a law to impose the will of the state to restore safety, law and order.
In understand, that the context is the single most important precursor to imposing of a law, and because of this I believe Gujarat is far more deserving to have the power of this law, than any of the goondaraj Kangress governed states. In Delhi, they never applied this law against those mafia or criminal cartels having their Kangress connection. All the 1984 pogrom killers of Congress party are freely roaming in the streets as a blatant display of terrorism.
GUJCOC was long awaited, and the Kangress was sitting on it deliberately to instigate riots in the state in hopes that frustration for justice goes beyond the bearing and could fetch them some more votes. I believe that police in Gujarat is far more disciplined to deserve this powerful mandate. Thanks to CM Narendra Modi.

The same law, provisions are in place in Maharashtra. But when Gujarat implements that, Congress is worried to protect the jihadis, thus deny this law. Anything is fine with Congress including appeasement of jihadis to come to power.

I am more than happy if GUJCOC is to be used against terrorists like Kasab. If that is the case, rules can be even more harsh than GUJCOC.
At the moment, we all know SIT is working so hard to frame Modi in post Godhara riots. Now, just imagine Gujarat DGP of Police says Modi admitted before me that he was involved in the riots. Who will save Modi from GUJCOC then ?
It can be anyone. You, me or any ordinary person of Gujarat. You need trustworthy and honest police force before you give them such deadly laws. With present corrupt police force, We need clear terms and conditions about invocation of GUJCOC. If you dont have that, you will be killed by your own weapon.
